TommyTrace1. About these Terms
These Terms & Conditions (the “Terms”) form a binding agreement between you and TommyTrace (“TommyTrace”, “we”, “us” or “our”) governing your access to and use of the TommyTrace game, website, mobile applications, accounts, multiplayer features, virtual currency, cosmetic items, purchases, promotions and related services (collectively, the “Service”). By creating or using an account, accessing the Service, or purchasing TommyTrace Coins or other digital content, you agree to these Terms.
2. Eligibility and minors
You must have legal capacity to enter into these Terms. If you are under the age at which you can legally enter into a contract in your jurisdiction, you may use the Service only with the permission and supervision of a parent or legal guardian, who is responsible for your use and purchases. You must not make a purchase using another person’s payment method without authorization.
3. Accounts and security
You are responsible for activity carried out through your TommyTrace account and for maintaining the security of your sign-in credentials and connected accounts. You must provide accurate information where required and promptly notify us through the available support channel if you believe your account or payment activity has been compromised. Accounts may not be sold, rented, transferred or shared for fraud, cheating, abuse or unauthorized purchasing.
4. Licence to use TommyTrace
Subject to these Terms, TommyTrace grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service for personal entertainment. Except where applicable law expressly permits otherwise, you must not copy, modify, reverse engineer, scrape, interfere with, bypass security controls of, or commercially exploit the Service.
5. TommyTrace Coins
TommyTrace Coins (“Coins”) are a limited virtual in-game currency for use only within TommyTrace. Coins are not legal tender, are not electronic money, do not represent a deposit or financial account, do not earn interest, have no guaranteed cash value, and cannot be redeemed or withdrawn for cash. Coins are licensed, not sold as property, and may be used only for eligible digital content offered in TommyTrace. Coins are normally non-transferable between accounts unless TommyTrace expressly provides a transfer feature.
6. Purchased and promotional Coins
Coins may be purchased for money or awarded through gameplay, promotions, advertisements, events or customer support. Promotional or free Coins may be subject to separate limits, expiry rules or eligibility conditions disclosed with the relevant promotion. We may correct balances created by technical errors, duplicate rewards, fraud or abuse, provided that we will not remove legitimately purchased Coins without a valid reason or where prohibited by applicable law.
7. Prices, taxes and payment
Prices are shown before you confirm a purchase. Web purchases may be processed by Stripe and mobile purchases may be processed by an authorized app-store billing provider. The payment provider may apply its own terms, payment methods, fraud checks and privacy practices. You authorize the selected provider to charge the displayed amount. Applicable taxes, fees or currency-conversion charges may be added or handled by the payment provider where required. We may change pack sizes or prices for future purchases, but a change will not alter a purchase already completed.
8. Digital delivery and payment verification
Coins are delivered to the TommyTrace account associated with the verified purchase. A payment is not treated as complete merely because a checkout screen reports success; TommyTrace may wait for server-side confirmation from the payment provider before crediting Coins. Delivery is normally prompt but may be delayed by payment processing, network outages, fraud review or technical issues. If you are charged but do not receive the purchased Coins, contact TommyTrace support and provide the relevant transaction information so the purchase can be investigated and restored where verified.
9. Refunds, cancellations and statutory rights
Because Coins and cosmetic items are digital content delivered to an account, purchases are generally final once correctly delivered and made available for use. However, this does not exclude or restrict any refund, remedy or consumer right that cannot lawfully be excluded. Refunds may also be provided for duplicate charges, unauthorized transactions, failed delivery, material technical errors, or other circumstances approved by TommyTrace or the payment provider. Any refund may be subject to the payment provider’s rules and applicable law.
10. Reversals, chargebacks and disputed payments
If a payment is cancelled, reversed, refunded or charged back, we may reverse the corresponding Coins and, where reasonably necessary and permitted by law, reverse digital items obtained using those Coins. We may temporarily restrict purchasing while a payment dispute is investigated. We will not treat a good-faith exercise of a lawful consumer right as misconduct; however, fraudulent chargebacks, repeated unauthorized-payment abuse or manipulation of the payment system may lead to account restrictions.
11. Cosmetic items and fair play
Avatars, skins, emblems, effects, profile decorations and other cosmetic items are for visual or personalization purposes unless expressly stated otherwise. Purchased cosmetics do not provide a guaranteed competitive advantage, higher score, extra time, map information or Ranked DUEL benefit. Cosmetic presentation may be adjusted for compatibility, performance, safety, licensing or design reasons, subject to applicable consumer rights.
12. Limited, seasonal and discontinued content
Some cosmetics, events or offers may be available only for a limited period. Availability does not guarantee that an item will be offered forever. If material changes affect paid digital content, TommyTrace will act reasonably and in accordance with applicable law, which may include maintaining access, providing a substantially equivalent replacement, or another appropriate remedy where required.
13. Prohibited conduct
- Do not exploit bugs, payment flows, advertisements, reward systems, matchmaking or account systems to obtain Coins, items, ranks or benefits improperly.
- Do not duplicate rewards, manipulate balances, submit false payment information, use stolen payment methods, abuse refunds or chargebacks, or attempt to bypass server-side purchase verification.
- Do not use bots, unauthorized automation, cheats, malicious code, denial-of-service techniques, scraping that harms the Service, or tools designed to interfere with other players or TommyTrace systems.
- Do not harass, threaten, impersonate, defraud or intentionally disrupt other users, including through friends, text chat, invitations or DUEL voice.
- Do not use chat or voice to share unlawful content, sexual content involving minors, threats, scams, malicious links, or another person’s private information without authorization.
- Do not use the Service in violation of applicable law or the rights of another person.
14. Enforcement, suspension and termination
We may warn, restrict, suspend or terminate access where we reasonably believe an account is involved in material breaches of these Terms, fraud, cheating, security attacks, unlawful conduct or serious harm to the Service or other users. Where appropriate, we may investigate before taking permanent action. Any enforcement will remain subject to rights and remedies you have under applicable law. Termination does not remove obligations or rights that by their nature survive termination.
15. Service availability, updates and maintenance
TommyTrace is an evolving online service. We may deploy patches, balance changes, security updates, new features, maintenance or temporary outages. We do not promise uninterrupted access to every game mode, Street View location, leaderboard, cosmetic, advertisement, payment method or third-party service. We will use reasonable efforts to maintain the Service, but some interruptions may be outside our control.
16. Third-party services
The Service may rely on third parties such as Stripe, Google, Supabase, Vercel, mapping providers, advertising networks, app stores and authentication providers. Your use of those services may also be governed by their own terms and privacy notices. TommyTrace is not responsible for a third party’s independent acts or outages to the extent permitted by law, but this does not affect any responsibility that applicable law places on TommyTrace.
17. Privacy and payment data
TommyTrace may process account identifiers, profile information, gameplay data, device or diagnostic data and purchase records to operate, secure and improve the Service, prevent fraud, provide support and comply with legal obligations. Payment card details entered into Stripe or an app-store checkout are processed by that payment provider and are not intended to be stored directly by TommyTrace. Personal data will be handled in accordance with applicable privacy law, including the Personal Data Protection Act 2010 (Act 709) and its amendments where applicable, together with any separate TommyTrace privacy notice.
18. Intellectual property
The TommyTrace name, software, user interface, original artwork, game assets, audiovisual content and other protected material are owned by TommyTrace or the relevant licensors. Buying Coins or digital items gives you only the limited in-Service usage rights described in these Terms; it does not transfer copyright, trade mark rights, source code, ownership of artwork or any other intellectual-property right.
19. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as available” basis. TommyTrace does not guarantee that the Service will always be error-free, uninterrupted, compatible with every device, or that every third-party map, advertisement or payment service will always be available. Nothing in this section excludes any guarantee, representation, warranty or statutory protection that cannot lawfully be excluded.
20. Limitation of liability
To the maximum extent permitted by law, TommyTrace will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when you accepted these Terms. Where liability may lawfully be limited, TommyTrace’s aggregate liability arising from paid digital purchases will not exceed the greater of the amount you paid to TommyTrace for the affected purchase or the amount required by applicable law. This limitation does not apply to liability that cannot legally be limited or excluded.
21. Consumer protection and Malaysian law
Nothing in these Terms is intended to contract out of rights that cannot be waived under applicable consumer law. In Malaysia, this includes rights that may arise under the Consumer Protection Act 1999 (Act 599), applicable electronic-commerce rules and other mandatory laws, as amended from time to time. Where applicable, a Malaysian consumer may also have access to statutory complaint or dispute-resolution channels such as the Tribunal for Consumer Claims Malaysia. Subject to those mandatory rights and any law that requires otherwise, these Terms and the Service are governed by the laws of Malaysia.
22. Disputes
If you have a purchase or account dispute, please contact TommyTrace support first so we can try to resolve it promptly. Nothing in these Terms prevents you from using a regulator, tribunal, court or other dispute-resolution process available to you under mandatory law. Subject to mandatory consumer jurisdiction rules, disputes not otherwise resolved are subject to the courts of Malaysia.
23. Changes to these Terms
We may update these Terms when the Service, payment model, legal requirements or business practices change. The current version and effective date will be displayed in the Service. If a change is material, we may require you to accept the updated Terms before making a new purchase or continuing to use affected features. Changes do not retroactively remove rights that have already accrued under applicable law.
24. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law. A failure to enforce a provision immediately is not a waiver of that provision. You may not assign your account or these Terms without our consent. TommyTrace may transfer its rights or obligations as part of a legitimate business reorganization, acquisition or transfer, subject to applicable law. These Terms, together with any policies expressly incorporated into them, form the agreement governing the Service.
25. Contact
For purchase, account, refund, security or legal issues, use the support or reporting channel provided inside TommyTrace. Where applicable law requires additional merchant identification or contact information, that information will be provided through the TommyTrace website, legal notice, checkout or payment record.
